We make a great
effort to produce healthy, genetically sound pups with great interest in birds
and hunting; but, if for a genetic reason your puppy is unsatisfactory in the
areas of physical health or natural ability, the following sales agreement is
in effect to avoid misunderstandings and to ensure fairness to our clients as
well as to ourselves.
If upon arrival
your puppy is not as it was represented by us in the areas of physical
description, personality, or ability, it may be returned to us the day after
arrival for a replacement. This only covers puppies that are shipped.
You have seven
(7) days in which to have your veterinarian examine your pup for any health
problems. If there is a problem that cannot be rectified, you may return the
puppy to us the day following the vet exam with a veterinarian’s statement for
a replacement puppy. Return of the puppy is the responsibility of the buyer.
The breeder accepts no responsibility for the veterinarian expenses after the
puppy leaves the breeder’s care. If we do not hear from you within seven (7)
days, we will assume that you are satisfied and that the pup is in good health.
The replacement will be reserved from the next available litter that would
produce puppies meeting the description of the original puppy.
If your dog
develops any of the following conditions, it shall be replaced by the breeder
with another puppy of equal value and similar quality, upon return of the
original dog. The replacement will be reserved from the next available litter
that would produce puppies meeting the description of the original dog. The
replacement shall be supplied free of all charges except shipping. If the value
of the replacement puppy is greater than the original purchase price, the buyer
will be responsible for paying the difference. The following portion of this
agreement is covered by replacement only. We don not five full or partial
refunds.
In the event that
the buyer makes a claim for a replacement puppy due to a genetic physical defect,
the breeder reserves the right to have our veterinarian examine any x-rays. The
breeder may also demand that the dog be returned and evaluated by our
veterinarian. If the claim is made due to the dog lacking natural hunting
ability, the breeder may demand the dog be returned so that the breeder may
evaluate the dog’s ability.
If, before the
age of thirteen (13) months, it is determined that the dog
Lacks the natural ability for hunting, or
Has limited interest in birds or hunting, or
Is untrainable, or
Shows unstable or vicious temperament, or
Has developed a serious genetic or congenital defect, it will be
replaced.
If, before the
age of twenty-seven (27) months, the dog develops:
Hip dysplasia, as evaluated by the Orthopedic Foundation for
Animals, or
Progressive Retinal Atrophy and/or Congenital Cataract, as
certified by an ACVO Diplomate veterinary
ophthalmologist, it will be replaced.
The buyer has
several responsibilities for the terms of this guarantee to remain in effect:
1) The breeder must be notified within fifteen (15) days of
diagnosis of hip dysplasia, progressive retinal atrophy, congenital cataract or
other defect that would be considered serious.
2) The dog must be returned to the breeder within thirty (30) days
after the breeder is notified of defect.
3) All shipping expenses are the responsibility of the buyer.
4) Buyers are responsible for all of their own veterinary fees.
5) The dog must be registered wit the Kirby Mountain prefix.
This replacement agreement
does not cover dogs that are as follows:
1) Any dog that has been bred or used for breeding prior to claim.
2) Any dog that has transferred ownership from the original
purchasing party.
3) Any dog that has died or has been injured due to an accident.
4) Any dog that has been abused or neglected.
5) Any dog that has been made to be man-shy or gun-shy.
6) Any dog whose vaccinations are not kept current. The dog’s
vaccination records must be supplied for the breeder’s review if they are
requested.
Claim for
replacement shall be in writing and shall be accompanied by the following:
1) Original A.K.C. or F.D.S.B. Registration Certificate with ownership
signed back to the breeder.
2) Veterinary certificate of hip or eye defect or other serious
defect as earlier described
This claim must
be submitted to the breeder with all required documents and the affected dog
returned within thirty (30) days after the breeder is notified of the defect.
If the buyer
wishes to keep the dog as a hunting dog and/or companion, that is the owner’s
option. No replacement will be given in
such cases.
Both the buyer
and the breeder have read this agreement and understand and agree to the
conditions named there in.
